Tricore Reference Laboratories
Implements the legal processes required to affect the privileges, obligations and rights of the organization. Plans, directs, coordinates and monitors the legal and risk management programs for the company to control risks and ensure that all company contracts are compliant with applicable law. Provide professional support and advice to senior management on various legal issues such as contracts, dispute resolution, governance, regulatory, and legal exposure. Develops processes, policies and procedures to identify and manage threats to the achievement of the organization’s operational, financial, legal and strategic objectives. Responsible for managing the regulatory oversight of all aspects of compliance: including risk, quality, privacy contracts, and legal affairs within multiple business units.
1. Compliance and Regulatory
a. Serves as the TriCore Compliance Officer, working with the CEO to independently and objectively review and evaluate compliance issues/concerns within TriCore. Responsible for the creation and implementation of Compliance policy for the entireorganization.
b. Independently reviews and evaluates compliance issues/concerns within TriCore to ensure they are appropriately evaluated, investigated and resolved.
c. Monitors organizational compliance activities to ensure compliance and to identify areas of compliance vulnerability and risk; develops/implements corrective action
plans for resolution of problematic issues; and provides guidance as to how to avoid future similar situations.
d. Oversees programs that maintain company adherence with licensure requirements and compliance with applicable regulatory authorities including HIPAA, CLIA, FDA, Medicare/Medicaid, OSHA, etc. Participate in and consult on internal and
external audits as required or appropriate.
2. Quality Systems
a. Directs staff to develop, implement, and improve the TriCore QA occurrence reporting and indicator monitoring processes.
b. Directs staff to ensure TriCore compliance with Quality Systems Management requirements, which include accreditation and licensure, auditing, proficiency testing, public health reporting, credit and charge monitoring, education and policy
c. Analyzes and audits control effectiveness and recommends control enhancements or process modifications for business efficiency.
d. Links risks and opportunities to key performance indicators and escalates to the appropriate business unit.
e. Participates on improvement teams and task forces as needed and/or requested.
f. Participates in internal and external audits and mock inspections.
g. Participates as a member of the Policy and Procedure Committee. Reviews policies and procedures for accuracy and completeness prior to the committee meetings.
3. Legal Services
a. Directs, performs legal research and analyzes implication of case law, legislation and regulatory matters that affect the organization; reporting them back to senior management.
b. Prepares opinions of counsel as required; anticipates and identifies legal issues in order to develop legal strategies and solutions.
c. Represents company in ensuring the efficient handling and resolution of negotiations and disputes to the benefit of the organization.
d. Ensures that legal documents and other contractual documents are effectively
drafted, reviewed, interpreted and vetted.
e. Serves as first line review for all TriCore legal questions, matters and actions; providing proactive legal assistance, advising and taking decisive action where required and appropriate.
f. Selects and oversees the work of internal and external legal resources serves as an interface with corporate attorneys as required or appropriate.
g. Provides legal updates applicable to management and to internal customers as
needed and appropriate.
h. Writes business legal reports and correspondence. Presents information to Senior
Management as needed or appropriate.
i. Provides weekly report to executive team on legal issues.
j. Designates, oversees and is responsible for the work product of internal paralegal staff.
4. Risk Services
a. Manages corporate insurance programs such as corporate general liability, property, auto, officers and directors and professional liability. Selects insurance brokers and carriers and places insurance.
b. Assists with insurance policy renewals, insurance claims management, issuance of certificates of insurance, budget planning and risk minimization programs.
c. Oversees the tracking maintenance of accurate data on certificates of insurance, property and vehicle inventories and valuations for insurance purposes and makes changes or recommendations for changes as needed.
d. Analyzes and classifies risks as to frequency and potential severity and measures financial impact of risk on company.
e. Directs loss prevention and risk programs; selects appropriate techniques and implements programs and policies to minimize loss, such as avoidance, loss prevention and reduction, retention, grouping of exposure units, and transfer.
f. Assesses and advises the company to effectively minimize and control risks, ensuring that enterprise-wide systems, controls and processes are appropriate and relevant.
g. Performs analysis of risk situations and provides weekly reports to executive management team.
h. Reviews relevant incidents, complaints, claims as part of a comprehensive enterprise-wide risk management program.
Bachelor’s degree in Business Administration or equivalent education and experience.
Five years’ recent clinical laboratory experience.
Master’s Degree in Business Administration or equivalent.
Experience in corporate, contract and health law.
Experience in a healthcare-related compliance department.
Experience in employment law.
